These preliminary terms of use apply exclusively to the pre-registration on the Apollum platform.
Apollum is currently still under development. Pre-registration allows users to create an account and store basic information. This does not yet provide access to the later features of the platform.
These preliminary terms of use apply only until the platform is launched or until full terms of use are introduced.
Through pre-registration, users may create a preliminary user account.
Pre-registration serves in particular to:
During the pre-launch phase, the following features are in particular not available:
Pre-registration does not create any entitlement to a specific feature, a specific launch date, or future activation.
Registration is only permitted if the information provided is complete, accurate, and up to date.
Users are obliged to keep their access credentials confidential and to protect them from access by third parties. Transfer of the account to third parties is not permitted.
Apollum may reject registrations or suspend or delete user accounts if false information is provided, if misuse of the service occurs, or if legitimate interests of Apollum or third parties are impaired.
Pre-registration does not constitute a commitment that an account will be activated for the full platform at a specific time or at all.
Apollum may modify, expand, restrict, or discontinue the platform, individual features, access models, or target groups prior to going live.
An entitlement to participate in specific features, conditions, roles, or user groups exists only if this has been expressly agreed separately.
Prior to use of the full platform, Apollum will provide complete terms of use.
Use of the activated platform is only possible once users have accepted the terms of use applicable at that time.
If the full terms of use are not accepted, the platform may not be used or may only be used to a limited extent. The preliminary user account may in such case be deleted or deactivated.
Users may not use pre-registration in an abusive manner.
In particular, the following are prohibited:
Apollum is entitled to remove unlawful or abusive content and to suspend accounts temporarily or permanently.
Apollum may contact users by email in connection with pre-registration, in particular to confirm registration, to manage the account, and to provide information about the platform launch.
Promotional communications are only sent where the user has given corresponding consent or a legal permission exists.
Apollum processes personal data exclusively in accordance with the applicable data protection regulations.
Details on the processing of personal data, in particular the nature, scope, purpose, and legal basis of processing, are set out in the Privacy Policy.
Pre-registration requires the processing of data necessary for account creation. Any voluntary information provided beyond this is processed only to the extent indicated in each case.
Apollum endeavours to provide pre-registration reliably. However, there is no entitlement to constant availability.
Since Apollum is still under development, technical changes, maintenance work, interruptions, or restrictions may occur.
Apollum may amend these preliminary terms of use to the extent required by technical, legal, or organisational developments.
Material changes will be communicated to users in an appropriate manner.
At the latest upon launch of the platform, these preliminary terms of use will be replaced or supplemented by full terms of use.
Users may have their preliminary user account deleted at any time by contacting Apollum at legal@apollum.com.
Apollum may delete or deactivate preliminary user accounts if pre-registration is terminated, if the platform is not pursued further, if users violate these terms, or if legitimate grounds for deletion or deactivation exist.
Apollum is liable without limitation in cases of intent and gross negligence, as well as in cases of injury to life, body, or health.
In cases of simple negligence, Apollum is only liable for breach of material contractual obligations. In such cases, liability is limited to the foreseeable damage typical for this type of contract.
Any further liability is excluded to the extent permitted by law.
Since pre-registration does not open up any fee-based platform use or marketplace operation, Apollum is not liable in particular for lost opportunities for use, activations that have not taken place, or expectations regarding the future scope of features.
The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
If users are consumers and mandatory consumer protection provisions of their state of habitual residence are more favourable, these remain unaffected.
Should individual provisions of these preliminary terms of use be or become invalid, the validity of the remaining provisions shall remain unaffected.
Apollum is entitled at any time to convert pre-registration into a regular platform registration, to amend it, or to discontinue it.
